it is getting worse. we'll keep watching it for you and tell you what we are expecting when it comes to rainfall amounts and when it is expected to arrive. we'll check the drive first with mike inouye. good morning, christina. we are watching for the effects on the commute. so far no issues reported by chp and your approach to the maze. the incident we had at southbound 880 at oak, the vehicle cleared from lanes but we have reports of highway 24 near camino pablo. it shouldn't be an issue but we'll see flashing lights. a live look at oakland and 880 shows steady lights coming northbound with headlights past the coliseum. no issues for the nemitz. back to you. changes are in the works to make rain-swoling creeks and canals a little safer. this comes in the wake of the tragic drowning of two walnut creek teenagers. christie smith is live with what county leaders may do. >> reporter: this was a real tram tragedy for the whole community of walnut creek. the teens were well liked and it

also sparked serious decision discussion on things like fencing and signage and access to local waterways. this after the rafting deaths more than a week ago of 16-year-old matthew miller and 17-year-old gavin powell. they drowned while trying to navigate a rain-swollen creek in a small inflatable raft. the contra costa public works department oversees the flood district and the canal, not specifically designed for recreational use. crew members have been looking closely at where the boys entered the water. they have launched a public awareness campaign. and supervisors are hoping to raise awareness to just how dangerous doing something like this can be. the public works department is expected to give a full report today to the board of supervisors. they meet this morning here in martinez at 9:30. reporting live in martinez, christie smith for "today in the bay." thank you for the update,

christie. >> an incredible confession this morning. the couple accused of kidnapping jaycee dugard and holding her captive for 18 years admitted to the crime. nancy garrido also confessed she knew her husband phillip raped dugard and she helped deliver the children jaycee bore him. >> the kids were born, she fed them and took them places. >> although phillip and nancy garrido confessed to the crime the couple have not yet worked out a plea deal. phillip garrido was scheduled to appear in court on march 17th. the confession is part of what nancy garrido's attorney shared with us. we have posted the entire interview on nbcbayarea.com. for the second time in a month police are investigating a near fatal hit-and-run in san jose. the latest happened sunday morning at the intersection of crucero drive near highway 101. a white minivan hit david garcia and dragged him several feet

before driving away. witnesses have not been able to provide much information. garcia is now in a medically-induced co ma this morning. there was another hit-and-run about two miles away three weeks ago. in that case 18-year-old erika luna was hit and dragged some 700 feet. she survived but she may never walk again. no arrests have been made in that case either. burglaries and car break-ins are on the rise in the korean business community. the break-ins are happening in santa clara near el camino and lawrence expressway. thieves crashed a van through a front door of a jewelry store and stole earrings and necklaces. they have also seen an increase in car break-ins and are afraid it will scare customers away. business leaders want to at security cameras outside of stores and in parking lots. they think it helps to catch the crooks for police. officers say a man is posing as a caltrans worker to get into

homes in woodside. last friday the suspect told a homeowner he was there to inspect the backyard for landslide danger. as he chatted with the homeowner police think a second suspect went into the home and stole jewelry. the professional poker player accused of brutally murdering his parents for money will return to the stand today. earnest sheer iii said he couldn't have killed his parents because he was asleep on the couch in his southern california home. he is accused of beating his parents to death with a baseball bat. he says he drove to his home in brea. he killed his parents to collect the $1 million inheritance. muni shelled out more than a half million in legal sediments to passengers injured in the 2009 collision in san francisco, and this morning muni could owe more money.

muni will consider settling 12 remaining claims. 40 claims have already been settled. the payouts come out of muni's budget. they have not determined the cause of the 2009 accident which resulted in dozens of injuries. 5:06 right now. right now a dozen little dogs are getting ready to catch a flight to the big apple. >> yes, bob redell is live in san francisco with what's going on. we promised flying chihuahuas and here they are. >> reporter: yeah, good morning to you, brent and laura. in a few hours later this morning these two guys along with 12 other chihuahuas are boarding the virgin american flight headed to the big apple. the overpopulation of chihuahuas is here on the west coast in san francisco and there's not enough in new york city. the director of san francisco's animal care and control, how do we end up with more and they end up with less? we are both two big

metropolises. >> we have seen a lot of them coming. l.a. has been sending them out. here in northern california we are getting many of them. people are not spaying and neutering. they think it is easy to breed chihuahuas, but they are dog and a lot of them end up in siblings. >> reporter: these are adorable. why would we have a problem with adopting them on the west coast? >> these two we may not, but we have seen a lot of chihuahuas sit here. one has been here for six months. she's a lovely dog, but she hasn't moved. there are just so many. and placing them all has become a real challenge. >> reporter: this is the third time you have done a shipment to back east. i assume the prior times they have adopted out right away and you expect that to happen again. >> very quickly. they went up for adoption for the first time last january. people were lined up around the corner at 7:00 a.m. for a noon adoption. and they had no problem. >> reporter: so i assume you tell people back at home even

though you are sending 14 out you still have plenty left here? >> yes, we have 20 left in the shelter. as of yesterday we had 34 chihuahuas out of 96 dogs in the shelter. we have plenty and more will come in. >> reporter: thank you. brent and laura, look at that. >> did i catch that right, the cats are in charge of the dogs? >> reporter: yeah. >> adorable. i think christina needs one for her red carpet debut with a fancy little dog and a diamond necklace. >> she is going to cinequest. i can say "that's hot" like paris. i do believe bob would look like his dog and dogs always take after their owners if you have a chihuahua. 34 degrees in novato. bring your chihuahuas in this morning because it is cold out there.

chp is just cleaning up the paperwork. i mentioned heading to the bay bridge toll plaza, driving to san francisco you see a steady flow of headlights on the upper deck. eastbound no problems heading out to treasure island. you will in both directions pass the new spiral off to the left side of the screen, but it is soaked in. nothing to distract you on the way to the east bay. keep driving. we'll have good pictures for you. we have an easy drive in and out of the east bay. fog could be drifting in to spots. antioch hasn't showed slowing for highway 4. 65 is still showing up at elle street. we'll see that dip over the next 25 minutes. livermore is moving smoothly, 580 after the big rig has cleared. everything has cleared from the right shoulder. that's great news out of the altamont pass. the south bay, we do see slowing at the top of your screen, eastbound 237. i double checked, no major issues there. you should be okay heading to

this is also the first day of march. hard to believe already. the year is flying by. a live look outside from the south bay this morning. a little rain in the works as well. we'll find out where and when with christina. 5:14 right now. a new tax on medical marijuana dispensaries begins today in san jose. the clinics are not even legal in san jose yet but the potential money they could bring in is too tempting for city leaders topaz up. they will begin to pay a 7% tax on their growth starting today. the city council hopes they will be a new source of rev new for the city budget. but opponents say that the 7% tax is high. it is one of the highest ones in the state. and they are saying it is not right to tax something when it is not even legal yet. we'll sort that out.

in the meantime, after three years of no salmon fishing off the coast of california, fishermen could be back in business. the state department of fish and game will host a meeting today in santa rosa to talk about the latest information on the outlook for this year's fishing season. commercial fishermen are optimistic about the meeting and think they will have a pretty good chance to fish this year because of the high number of adolescent fish found in california waters. today's meeting will be held at the sonoma water agency from 11:00 to 2:30 this afternoon. speaking of fish, you are a big fly fisherman. when does the season start for that? >> most of them it is going to come up in late april. >> all right. always cold out there in the water, but it doesn't deter the fly fishermen, christina. i would love to see you in a pair of waders, laura

amazing end for wall street as a whole. all of them gaped 3%. if history is any guide, 2011 will definitely be an up year for stocks. because since 1940 the dow rose in january and february 26 times. it closed higher 25 of those 26 times. so the odds are with us. the dow adding 95 points on monday to 12,226. the nasdaq composite also add ing to 27. the japanese brands make the best vehicles overall, but ford did make some gapes, specifically in quality. it ranks highest among u.s. automakers with improvements in road tests and reliability. all right. an electric luxury car? it could be a reality one day.

rolls royce is showing off a plug-in car. let me repeat that this morning, rolls royce is showing off a plug-in car, seriously. it is called the phantom 102-x. it can actually run up to 120 miles before it needs a recharge. there you go. some other car headlines making news, gm's new electric car is more affordable. it came up short in consumer reports ranking. testers say the heavy volt is fun to drive but in fuel efficiency you are probably better off with a hybrid like a toyota prius or ford fusion. a volt rap just 26 miles before it rap out of gas. and the engine kicked in. after out thing the 40 mile electric range for most of volt's development, they have been back-tracking a bit saying it has adopted a sliding scale

7:00 p.m. tonight. we'll track those for you throughout the morning to let you know how much we are expecting. i can tell you right now it is definitely more than a half of an inch. we could see localized flooding out of this one. 34 in novato. 38 in san mateo. pretty mild along the peninsula. much cooler inland. grab the jacket. you probably want to bring the umbrella if you are someone who works late and gets off work later this evening. we'll tell you when the showers are expected to arrive. as i said before, how much we are expecting in all bay area cities coming up. we'll get you to work right on time. and the man to do that is mike inouye. good morning to you, mike. good morning, christina. good news for you in the morning commute, we should be relatively quiet. 580 behind me, look at the cool camaro going westbound on 580 around the bend. we are seeing the slowing on 580. you can see the yellow cars in the distance, but those are in the eastbound distance. that's unusual. no instances reported for eastbound or westbound. that's a 14-minute drive out of

the altamont pass. a steady build through livermore. antioch westbound we see yellow speed indicators at 50 miles per hour. we'll end with the map. back to you guys. there's the east bay buildup through oakland as well. this morning thousands of pages of documents related to the ongoing investigation into the san bruno explosion will be made public. day one of a three-day hearing begins in washington, d.c., today. pg&e pipeline engineers and operations managers will be the first to testify before the national transportation hearing board. the hearings are scheduled to start at 6:00 our time. it will be streamed live online on the ntsb website. the grouping of two east bay teams is prompting safety changes along rain-swollen creeks and canals. christie smith is live in martinez with what could be done. christie? >> reporter: good morning to you. i can tell you the public works department has been looking at this very closely, ever since this tragedy happened.

going down to the creek to take a look for themselves they are going to present a report today inside of the board of supervisors' chambers inside this building later today. they are looking at how to prevent a tragedy like this from happening again. what they are recommending is that the best way to do that is to raise awareness working with school districts, public access television, getting the word out to the public about how dangerous fast-moving storm water in rivers and creeks really can be. this after the deaths of 16-year-old matthew miller and 17-year-old gavin powell who drowned more than a week ago after getting into an inflatable raft in walnut creek. apparently at the entry point there is a sign that says "no trespassing" and there's also fencing. adjacent to the area near the creek there are no signs or fences. so the contra costa flood control district is looking at trying to warn people about what these waterways are really for. and that's not recreational use

and how playing or swim iming a getting too close can be dangerous. following a drowning in the same area in 1991 there was a sign that said stay out, stay alive. that was painted on the cement near one of these creekses. they are hoping that could be a jumping off point for a new campaign. reporting live in martinez, christie smith, "today in the bay." barry bonds' attorneys are headed back to court today. it is the final day of motions before the march 21st perjury trial starts. one of the motions will decide if bonds' ex-girlfriend can testify in the trial. kimberly bell once posed for "playboy." the judge says her nude photos can't be used in the trial. bond is accused of lying to a grand jury about steroid use in 2007. many aftershocks are hitting

the geyser area after a minor 4.3 earthquake yesterday evening that struck 25 miles north of santa rosa at 6:00. since then there have been dozens of aftershocks. the biggest one hit at 3:00 this morning. it was about a 1.6. and an incredible admission for guilt. the attorney for nancy garrido says he and her husband made a full confession. nancy garrido is making the confession in hopes of getting a reduced sentence for the alleged kidnapping and rape of jaycee dugard. his compliant admits to grabbing dugard when she was 11 years old off the streets in south lake tahoe. he says garrido admits her husband drove the car and also claims that nancy garrido had nothing to do with the sexual abuse of dugard. authorities say that phillip garrido fathered two girls with

dugard. >> she's guilty of kidnapping and a bunch of other charges, but i think at least based on what happened after all the stuff started to become the bizarre family that she should be able to at least walk on the beach probably with a walker at some point in time before she dies. >> the couple has not worked out a plea deal so it is not known what impact these confessions might have on the legal process. the san jose city council has a full slate of issues to talk about tonight, most of them center on financial issues. they will reach an agreement with team san jose to cut money to four venues that operate within the city. the city wants to factor performance when deciding who gets laid off. during the last council meeting city leaders grounded the police department's helicopter for three months to save money. san francisco is getting ready for a big sendoff for a dozen little passengers. >> yes, they are pretty cute,

too. bob redell is live at sfo with an update for us. >> reporter: good morning to you, laura and brent. you have to wonder about the human passengers to board a couple virgin american flights later this morning headed to new york city. you have to wonder what they think when they see some of their fellow passengers onboard. s.f. animal control is just pulling up curb side here at the international terminal. inside the van there are 14 chihuahuas heading from our neck of the woods to the east coast where they can be adopted out. and the reason is because here in san francisco we have an overpopulation of chihuahuas. and in the big apple in new york they don't have enough. we'll see if we can catch rebecca here. let's see who we have in here. we have 14 little fellas who are -- they've got, you think it won't be a problem trying to get these guys adopted out on the east coast? >> i think they will go quickly on the east coast. there's a high demand there. i hear from folks there that they were just waiting and

thinking about where they were going to get small dogs from. so they are eager for them. >> reporter: why is it so hard on san francisco to get these guys adopted out? >> because we have so many of them. one of the dogs we are taking -- quickly, that's a chihuahua. he is a mix with a terrier. he's a chihuahua mix for sure. >> reporter: back to your answer about the difficulty of getting them adopted -- >> yes, we have had one in our shelter for over six months. it is almost seven months now. so, you know, they just stay for a long period of time. as much as we are proud of the work we do, the shelter is not the best place for any animal. >> reporter: rebecca, thank you very much. they are sending 14 out. and you would think, wow, they won't have any left in the shelter. absolutely not. we were told earlier they still have another 20 of these sitting and waiting to be adopted at the s.f. animal control here in san francisco. reporting live outside sfo, bob redell for "today in the bay."

disproportionately affect teachers pay. so now it would go to the house, if it passes the house, it goes to the senate. democrats are saying they are willing to compromise all of this to avoid a government shutdown at the end of the week on friday. also, states are dealing with their own budget crises. president obama talked to a lot of the governors yesterday at the white house. he said that vilifying public employees is not the answer. the most dominantly dealing with this is wisconsin. president obama suggested this is not the way to go. he also said that he would compromise when it comes to his new health law as long as states coming up with a way to accent the law, not to weaken it. laura? >> thank you very much, tracie. an investigation is underway after peninsula police shot and killed a gunman. his family says he has a history of mental illness. police say 35-year-old robert

karin threat upped employees at a local pharmacy and went to his parents' house. a neighbor called police saying a man with a gun was causing a disturbance. when officers arrived they say they tried talked to karin but he fired at them and ran. police chased him to a backyard and returned fire. that's when they shot and killed him. the two officers involved in the shooting are on paid leave while the san mateo police department and the district attorney's office investigates. karin's home says he had a history of mental illness. a new statewide energy initiative kicks off today that could save you thousands of dollars. you could get rebates of up to $4,000. it will depend on the energy you are able to save and the utility provider. the $300 million program is called energy upgrade california. the goal of the program is to reduce household energy use, save consumers money on utility bills and create jobs in the state's building performance industry. east palo alto is breaking

december. last night they started to bolt the fourth peg, so to speak, into place. that will bring the tower to 480 feet. they still have another section to go. and when it is finished it will be 525 feet. so again that work is going on in the bay bridge this morning. it will be interesting to see, but don't let it distract you on the morning roadways. let's check the commute now with mike. >> don't focus on the side of the road, focus on the road crossing over the bay. we'll look over here and focus on the slowdown for highway 4 from eighth street over to love ridge. the typical slowing is holding stead zi in the section near 25. we also have metal debris flying around reportedly landing in the slow lane. the pittsburgh bay point is slowing near bailey. a 15-minute drive out of the altamont pass through livermore. the westbound commute direction is heading to the dublin interchange. a look at the san mateo bridge,

880 is still move running at the speed limit. watch it slowing near the toll plaza from 92. the south bay shows slowing at 101 near 680 and into downtown into 280. the sharks are playing downtown. cinequest is going on downtown as well. there's a backup at the toll plaza, but no metering lights yet. those will probably turn on in 20 minutes or so. back to you. 5:54 right now. a budget battle is causing major protest across the state. more than 75,000 protesters rallied over the weekend in opposition to wisconsin governor scott walker's plan to fix the state's budget problems. the plan will include major cuts to schools and unions as he tries to fix a $3.6 billion deficit, which is expected in the next two years. walker is defending his plan saying the cuts are needed to prevent layoffs by 2013. charlie sheen is not normal, he's open about that, but the
